Conservation Transactions, Mitigation Banking, and Open Space Preservation

EMS routinely advises clients on matters relating to land transactions that serve conservation or regulatory purposes, including purchase and sale of conservation easements.  We have also guided and facilitated the establishment of agency-approved mitigation banks to allow for the sale of credits to satisfy compensatory mitigation requirements under the ESA and Section 404 of the CWA.
